El presente artículo propone un análisis sobre el derecho a la libertad de expresión de jueces y magistrados desde la perspectiva de los estándares de derechos huma­nos en el ámbito regional e internacional, a través de la normativa y la práctica jurisprudencial al respecto. El trabajo pretende arrojar luz sobre las posibles res­tricciones a las que se podrían ver sometidos en este ámbito los miembros de la ju­dicatura con motivo del especial contenido de las funciones que desarrollan. En este artículo se presenta una propuesta formativa utilizando el cine como material cultural y fuente de conocimiento. Una película como Babel permite trabajar la globalización y la educación de la ciudadanía, con planteamientos que exigen un nuevo humanismo, una nueva relación interpersonal, conscientes de los problemas de comunicación, prejuicios y choques culturales derivados del desarrollo tecnológico. La película cuestiona esta existencia en un mundo global interrelacionado, evocando el viejo mito bíblico de la Torre de Babel haciendo énfasis en identificaciones (...) erróneas, malentendidos y oportunidades fallidas, como manos invisibles que nos guían; o el fin cuyo destino se nos escapa.Babel hace comprender la realidad de la globalización. Nos permite observar cuatro lugares tan distantes como Estados Unidos, Méjico, Marruecos y Japón, no sólo distanciados físicamente. Los cuatro países representan estilos culturales diferentes, tres formas de realización humana. Asistimos al choque, a la incomunicación personal, al aislamiento por la diferencia de cultura y la ficticia proximidad tecnológica. Vivimos juntos, pero aislados los unos de los otros. (shrink)

The use in psychology of crowdsourcing platforms as a method of data collection has been increasing in popularity because of its relative ease and versatility. Our goal is to adapt the Gratitude Questionnaire–20 Items to the English language by using data collected through a crowdsourcing platform. The G20 is a comprehensive instrument that takes in consideration the different basic processes of gratitude and assesses the construct’s cognitive, evaluative, emotional, and behavioral processes. We test the psychometric properties of the English version (...) of the G20 with a Prolific user sample. We assess the adequacy of the G20 for the crowdsourcing population in its English version. A description of the characteristics of the participants is conducted. Reliability analyses reveal an optimal internal consistency of the adapted scale. The results are discussed from a cross-cultural vision of gratitude. We conclude that the Gratitude Questionnaire–20 Items, adapted to English with an American sample, is a psychometrically strong instrument to measure gratitude using crowdsourcing platforms for data collection and, therefore, a reference and useful tool in future research. The metaphysical question presupposes the ontological one: are there forms of social unit that can be recognized as real groups and, if so, what are they? The ontological answer can be affirmative only if we are able to identify real collective entities, that is, social wholes that are not reducible to the mere sum of their individual parts. Through an ontological comparison between different types of social interaction, this paper shows the ontological properties of a real collective subject. It is (...) such, only if relations between its constituent parts generate an intrinsic normative structure, which gives existence to a higher order of social units. In this order members are bound to each other and are collectively bound to their group. They are bearers of collective intentionality. Their actions contribute to collective agency. Their responsibility is more complex and stratified than that of an independent individual. Moreover, all types of real wholes depend on ontological constitution processes, which give them the following: an intrinsic structural unit, a typological identity and emerging properties. The latter can be both new characteristics and new causal powers, which constituent parts do not have. Therefore, a right understanding of these ontological constitution processes is capable of overcoming reductionist isomorphism. It also offers the fundamental criterion for proposing a metaphysical theory that, being rooted in a rigorous ontology, is not an arbitrary exercise of imagination. (shrink)

My purpose in this essay is to clarify and evaluate Arthur Schopenhauer's grounds for the view that happiness is impossible. I shall distinguish two of his arguments for that view and argue that both of them are unsound. Both arguments involve premises grounded on a problematic view, namely, that desires have no objects. What makes this view problematic is that, in each of the two arguments, it conflicts with Schopenhauer's grounds for other premises in the argument. I shall then propose (...) a way of fixing both arguments. The solution involves substituting the view that desires have no objects with the view that we have a desire to have desires. The latter view, I shall argue, can do the grounding work that the former does in Schopenhauer's arguments but, unlike it, the view that we desire to desire is consistent with Schopenhauer's grounds for the rest of premises in those arguments. The purpose of this essay is to account for privileged access or, more precisely, the special kind of epistemic right that we have to some beliefs about our own mental states. My account will have the following two main virtues. First of all, it will only appeal to those conceptual elements that, arguably, we already use in order to account for perceptual knowledge. Secondly, it will constitute a naturalizing account of privileged access in that it does not posit any mysterious (...) faculty of introspection or "inner perception" mechanism. (shrink)

Marzoa, cómo incluso a través de los autores que con mayor rigor enfrentan la lectura de la obra de Marx, se filtra, de diversos modos, parte del material conceptual alienado que constituye la ideología, así como versiones tópicas de determinadas desviaciones del pensamiento marxiano. Lo que vale para Martínez Marzoa (quien, a juicio del autor del presente artículo, es uno de los (...) mejores intérpretes de Marx) vale, también, para Althusser, en parte para la “escuela de Frankfurt” y otras corrientes postmodernas. Nursing policy and healthcare reform are focusing on two, interconnected areas: person‐centred care and fundamental care. Each initiative emphasises a positive nurse–patient relationship. For these initiatives to work, nurses require guidance for how they can best develop and maintain relationships with their patients in practice. Although empirical evidence on the nurse–patient relationship is increasing, findings derived from this research are not readily or easily transferable to the complexities and diversities of nursing practice. This study describes a novel methodological approach, called (...) holistic interpretive synthesis (HIS), for interpreting empirical research findings to create practice‐relevant recommendations for nurses. Using HIS, umbrella review findings on the nurse–patient relationship are interpreted through the lens of the Fundamentals of Care Framework. The recommendations for the nurse–patient relationship created through this approach can be used by nurses to establish, maintain and evaluate therapeutic relationships with patients to deliver person‐centred fundamental care. Future research should evaluate the validity and impact of these recommendations and test the feasibility of using HIS for other areas of nursing practice and further refine the approach. (shrink)

In recent years, several studies have advocated the need to expand the concept of patient autonomy beyond the capacity to deliberate and make decisions regarding a specific medical intervention or treatment (decision-making or decisional autonomy). Arguing along the same lines, this paper proposes a multidimensional concept of patient autonomy (decisional, executive, functional, informative and narrative) and argues that determining the specific aspect of autonomy affected is the first step towards protecting or promoting (and respecting) patient autonomy. These different manifestations of (...) autonomy are not mutually dependent; there may be patients who have problems in one dimension, while at the same time being fully autonomous in others. Nevertheless, a close interaction has been observed between the various dimensions and indeed, a phenomenological analysis shows that damage to or a reduction in one aspect of people’s capacity for self-government generally affects other aspects of their autonomy, which in turn disrupts their identity and the way in which they see themselves and are seen by others. In this paper, I shall examine some of these interactions and show how they may lie at the heart of the problem of poor treatment adherence (where adherence is defined as being the extent to which a patient’s behavior over time coincides with the recommendations made by and agreed with their health professional). One example given is that of psoriasis, a chronic skin disease with a very poor adherence record. In Spain, it is calculated that 85% of patients diagnosed with mild to moderate psoriasis fail to comply properly with their treatment, and figures from other parts of the world are similar. Although there are many possible causes for non-adherence among psoriasis patients, assessing their decisional, executive and narrative capacities and taking appropriate action based on the results may help increase adherence rates. In this paper, I propose an account of self-knowledge for desires. According to this account, we form beliefs about our own desires on the basis of our grounds for those desires. First, I distinguish several types of desires and their corresponding grounds. Next, I make the case that we usually believe that we have a certain desire on the basis of our grounds for it. Then, I argue that a belief formed thus is epistemically privileged. Finally, I compare this account (...) to two other similar accounts of self-knowledge. (shrink)

Although most consumers are positive about socially responsible companies, in order to benefit from CSR efforts, effective and clear CSR communication is important. However, due to the constantly rising profusion of eco-labels, based on either own claims from the organization or claims made by an external third party, consumers may encounter difficulties in identifying truly responsible firms, which could result in less effective CSR initiatives, even for those responsible firms. Therefore, building on attribution theory, this study seeks to identify how (...) uncertified internal CSR claims and external third-party CSR labels should be used in order to deter greenwashing and increase positive consumer evaluations. Within a 3 × 2 design, respondents are exposed to different coffee product packages measuring their attitude toward the brand, corporate credibility, purchase intention, and scent perception, as well as perceived attributional CSR motives. Overall, findings indicate that especially an external CSR label affects consumer responses toward the firm. Moreover, perceived CSR motives serve as a mediator between an external CSR label and corporate credibility and brand attitude, respectively. These findings warrant further consideration of introducing an external multilevel rating systems by governmental law. (shrink)

All paradoxes of self-reference seem to share some structural features. Russell in 1908 and especially Priest nowadays have advanced structural descriptions that successfully identify necessary conditions for having a paradox of this kind. I examine in this paper Priest’s description of these paradoxes, the Inclosure Scheme (IS), and consider in what sense it may help us understand and solve the problems they pose. However, I also consider the limitations of this kind of structural descriptions and give arguments against Priest’s use (...) of IS in favour of dialetheism. IS fails to identify sufficient conditions for having a paradox of self-reference. That means that, even if we identified a problem common to any reasoning satisfying IS, that problem would not explain why some of those reasonings are paradoxical and some others are not. Therefore IS cannot justify by itself the claim that some particular theory offers the best solution to the paradoxes of self-reference. We still need to consider aspects concerning the content and context of occurrence of every paradox. (shrink)

Mi propósito en este trabajo es reconsiderar una de las lecturas más relevantes y provocativas que se han hecho sobre John Dewey en el mundo de habla hispana. En la primera parte reconstruyo las circunstancias que rodearon la difusión, interpretación y traducción de las obras de Dewey en el México de mediados de los años 1940, y en concreto las razones que llevaron a que la visión sociológica que José Medina Echavarría quiso dar de Dewey fuera finalmente desplazada por la (...) filosófica de José Gaos. En la segunda parte analizo la traducción y lectura que Gaos hizo de Experience and Nature de Dewey, teniendo muy presente sus comparaciones con Sein und Zeit de Heidegger . Finalmente, propongo algunas críticas a la visión que Gaos transmite de Dewey como un pensador carente de un tipo de "soberbia diabólica" propia de la verdadera gran filosofía. The purpose of this work is a reconsideration of one of the most relevant and provocative readings of John Dewey written in the Hispanic World. In the first part I reconstruct the circumstances which surrounded the publicity, interpretation and translation of John Dewey's works in the Mexico of the middle 1940's, particularly the reasons why the sociological reading of Dewey that José Medina Echavarría proposed was finally displaced by the metaphysic perspective of José Gaos. In the second part I reconsider Gaos' own translation and interpretation of Experience and Nature, taking in consideration his comparisons with Heidegger's Sein und Zeit . Finally I analyze critically Gaos' view of Dewey as a thinker whose philosophy lacked the "diabolical arrogance" that true great philosophy would seem to require. (shrink)

The Fundamentals of Care Framework is an evidence‐based, theory‐informed framework that conceptualises high‐quality fundamental care. The Framework places the nurse–patient relationship at the centre of care provision and outlines the nurse behaviours required for relationship development. Numerous instruments exist to measure behavioural aspects of the nurse–patient relationship; however, the literature offers little guidance on which instruments are psychometrically sound and best measure the core relationship elements of the Fundamentals of Care Framework. This study evaluated the quality of nurse–patient relationship instruments (...) by (1) assessing their content development and measurement properties (e.g. dimensionality, targeting, reliability, validity) and (2) mapping instrument content to the Framework's core relationship elements: trust, focus, anticipate, know, and evaluate. Twenty‐seven instruments were evaluated. Findings demonstrated that patients and nurses were rarely involved in item development. Most instruments exhibited poor measurement properties, with only one instrument having complete information on all quality indicators. Instrument content focused primarily on nurses getting to know patients and earning their trust, with only 54, 18, and 1 item(s), respectively, measuring ‘focus’, ‘anticipate’ and ‘evaluate’. Hence, there does not appear to be a robust instrument measuring behavioural aspects of nurse–patient relationships, nor one capturing the relationship elements of the Fundamentals of Care Framework. Summary This paper aims to bridge anthropological and cognitivist research undertaken by Gilbert Durand and Mark Johnson, who studied the phenomenon of meaning making in a similar way, although they had to use different terminology as their disciplines demanded. Durand established systematization for analyzing symbolism by taking into account the position of the body and the perceptions determining the underlying schemata of symbols. Two decades later, Mark Johnson described image schemata as gestalts having an internal structure derived from bodily perceptions. (...) Owing to these similarities, a comparison between Durand and Johnson’s theories is offered first. In the second place, I reviewed the cognitive value of the anthropological regimes of imaginaire described by Durand. During the analysis, the terminology used by these theorists (like ‘image schemata’ or ‘axiomatic schemata’) was comparatively analyzed to find common ground between their positions. In conclusion, the need for recovering theories of imagination proposed by heterodox scholars like Durand is highlighted, since they anticipate the role of images and imagination not only in language, as Johnson demonstrated, but also in the formation of anthropologically relevant symbols, which are of interest for the analysis of literature and other arts. La evidencia empírica disponible señala de manera unánime que las nuevas políticas de tráfico y seguridad vial aplicadas en España desde 2004, y en particular la introducción del carné por puntos y la reforma del Código Penal, han tenido una fuerte incidencia positiva en la reducción de la siniestralidad. De dichos resultados se deriva que las nuevas políticas han tenido también un efecto positivo sobre la conducta de los conductores, de modo que ha sido esa mejora en la conducta al (...) volante la que finalmente se ha traducido en una reducción de la siniestralidad. No obstante, hasta el momento, los investigadores han descuidado el análisis directo de los datos sobre cumplimiento. En el presente trabajo se analizan todos los datos disponibles que ofrecen información sobre el cumplimiento de la normativa de tráfico y seguridad vial. (shrink)

Are those judgments that we make on the basis of our memories immune to error through misidentification? In this paper, I discuss a phenomenon which seems to suggest that they are not; the phenomenon of observer memory. I argue that observer memories fail to show that memory judgments are not IEM. However, the discussion of observer memories will reveal an interesting fact about the perspectivity of memory; a fact that puts us on the right path towards explaining why memory judgments (...) are indeed IEM. The main tenet in the account of IEM to be proposed is that this aspect of memory is grounded, on the one hand, on the intentionality of perception and, on the other hand, on the relation between the intentionality of perception and that of memory. Research on individual differences in facing the COVID-19 pandemic seems to be crucial in order to design diverse and highly effective intervention strategies. This study uses a sample of 302 North American participants who were recruited through the crowdsourcing platform ProA; different profiles were established, profiling variables of interest in facing the COVID-19 outbreak. Socio-demographic and psychological (personality traits, gratitude, life purpose, and religiosity) variables were explored. These results are of interest if we want to deepen the study of individual (...) differences at both a theoretical and applied level. (shrink)

Our memories elicit, in us, both beliefs about what the external world was like in the past, and beliefs about what our own past experience of it was like in the past. What explains the power of memories to do that? I tackle this question by offering an account of the content of our memories. According to this account, our memories are ‘token-reflexives’, in that they represent their own causal origin. My main contention will be that our memories are able (...) to provide us with evidence for the two types of beliefs due to the self-referential nature of their content. First, I will put forward a series of thought-experiments intended to raise several intuitions about the veridicality of memories. Next, I will introduce the view that memories are token-reflexives, and I will motivate it by pointing out that the view accommodates the relevant intuitions. And, then, I will return to the two types of beliefs prompted by our memories, and argue that conceiving memories as token-reflexives allows us to explain why memory has the power to elicit the two types of beliefs in us. Base-of-the-pyramid business models aim to achieve profitability and poverty reduction by including poor people into corporate value chains. This goal duality creates tensions. Actors’ responses to these tensions are influenced by their cognitive frames of the phenomena building the tension. Applying a cognitive perspective, I investigate how corporate actors with different frames of poverty respond proactively or defensively to the poverty–profitability tension by adapting business model elements. I find that proactive and defensive responses differ for actors holding different cognitive frames (...) of poverty. Aunque la presencia de subjetividades negras no es nueva en la literatura latinoamericana, el campo no había adquirido la fuerza ni la recurrencia utópica que ha logrado en los últimos quince años. Esto se articula con el avasallante movimiento socio-político ‘afrodescendiente’ –categoría identitaria consensuada en el año 2000–, que ha creado una retórica desde la antropología, la sociología, el campo jurídico, etc. que también ha permeado el discurso literario. Propongo en este artículo que la racialización positiva y desde debajo, es (...) decir, desde los mismos sectores subalternizados, de los últimos años, ha provocado una retórica estimulante de un “deber ser” afrodescendiente que se reitera a lo largo de la obra, no solo ficcional, sino también de cierto sector de la crítica. Este trabajo intenta problematizar la fuerza con que la retórica de las producciones de identidad afrodescendiente ha ingresado en la crítica literaria hispanoamericana de los últimos años provocando, en algunos casos, lecturas generalizadoras y racializadas que naturalizanla idea de pre-existencia y transhistoricidad de un ‘ser afro’. Si en las relaciones de fiestas virreinales la profusa descripción de todos los elementos que revisten el acontecimiento es una de sus marcas de estilo, el texto de 1621 titulado Verdadera relación de una máscara que los artífices del gremio de la platería de México y devotos del glorioso San Isidro hicieron en honra de su gloriosa beatificación resulta paradigmático sobre la relevancia de la cultura material para la construcción de la imagen de Carlos V y de todos los elementos (...) del desfile. Los vestidos, las alhajas, los objetos son centrales para la edificación iconográfica del mito del héroe y para propagar la imagen heroica de España. El presente trabajo analiza tanto esta cultura material que el texto retrata como su dimensión con respecto a la recepción en América de personajes literarios e históricos y la especial significación que el contexto les imprime.
